MPs from UKROP ask the Constitutional Court to declare illegal the abolition of retirement by seniority

The MPs from UKROP have appealed to the Constitutional Court with a demand to declare unconstitutional the abolition of retirement by seniority. The corresponding appeal to the court was sent by the chairman of the UKROP political council, MP Taras Batenko and MP Iryna Konstankevych, signed by 48 other MPs.

These are the norms of the Law “On amendments to certain legislative acts of Ukraine on rise in pensions” No. 2148-VIII. After the new document comes into force, the right to preferential retirement will be given only to the artists of theatrical concerts and other spectacular institutions, enterprises and collectives.

At the same time, the so-called pension reform ignores the provisions of the Law “On Pension Protection” adopted in 1991, according to which the right to early retirement is given to the citizens whose work results in a loss of professional ability before retirement age. These are military and law enforcement officers, civil aviation and flight test personnel, civil servants, judges, prosecutors and customs authorities, as well as certain categories of workers and specialists from other sectors of the national economy.

Similarly, the new legislation does not take into account the provisions of the Law “On Education” No. 2145-VIII, which guarantees retirement by seniority for pedagogical and scientific workers who carry out educational, methodological, scientific and organizational activities in higher educational institutions.

“Because of the professional depletion of the nervous system for a significant part of the teaching staff, pension by seniority is a vital factor,” the authors emphasized.

According to the UKROP members, the abolition of retirement under preferential conditions contradicts the Article 22 of the Constitution of Ukraine, according to which the restriction of already existing rights and freedoms of citizens is inadmissible.

“In order to protect the constitutional rights and freedoms of the Ukrainian citizens, ensuring the observance of the rule of law, we consider it necessary to ask the Constitutional Court of Ukraine to verify certain provisions of the Law “On amendments to certain legislative acts of Ukraine on rise in pensions” for compliance with the Constitution of Ukraine,” the document says.
