Having examined the motion submitted by the Chairman of Pechersk District Court of Kyiv on changing jurisdiction of Hennady Korban’s case from Pechersk to Dniprovsk Disctict Court, the panel of judges of the Court of Appeal consisting of judges Verhovets, Kovalska and Kepkal decided to leave the case for consideration in Pechersk Court. This decision was met by those present in the courtroom with applause and shouts “Thank you!”. Thus the court declared illegal the transfer of Korban’s case from Pechersk to Dniprovsk Court, where, in particular, the judge Mykola Chaus made decision on politician’s arrest and his taking into custody.
According to the lawyer of the member of the presidium of UKROP political council, today’s decision of the Appeal Court of Kyiv on leaving without consideration the motion of the Chairman of Pechersk District Court on changing jurisdiction of Hennady Korban’s case actually determines that all the requests within the politician’s case should be considered by Pechersk Court only.
“Now we can say that according to the defined jurisdiction all the complaints and petitions within “Korban’s case” are to be considered by Pechersk Court,” said the politician’s lawyer Yuriy Sukhov to the journalists. Thus, the defence will submit all further requests and complaints to Pechersk District Court only.
“The Chairman of Pechersk Court wanted this case to be considered by Dniprovsk Court. This motion was unsatisfied and now the case will be returned to Pechersk Court,” added Hennady Korban’s defender Oleksiy Shevchuk. At the same time the lawyer said the defence will provide the appropriate decision while consideration of the appeal against the decision of Dniprovsk District Court on Hennady Korban’s arrest.
The lawyers also said they would find out the reasons why the panel of judges of Kyiv Appeal Court consisting of Denys Masenko, Victor Hlynianyy and Valeriy Lashevych assigned the hearing on the merits of the complaints submitted by Hennady Korban’s lawyers at 11.00 on February 3, while they had been informed that another hearing involving Hennady Korban and his lawyers was scheduled for the same time.
