The court satisfies the prosecutors’ petition in Hennadiy Korban’s case whereby they try to delay the hearing, the lawyers confirm

Hennadiy Korban’s lawyers Oksana Tomchuk and Oleksandr Lysak object to satisfaction of the prosecutors petition to summon as witnesses Deputy Chief Physicians of Amosov Institute Oleksandr Berehovyy and Kostyantyn Rudenko and Doctor Irina Shvets to clarify the circumstances on the health condition of a member of the presidium of UKROP’s political council. 

“Now we face yet another attempt to replace the actually appointed investigative action - forensic examination, lawyer Oksana Tomchuk says. She notes that the defense has repeatedly insisted on the completion of the forensic examination, which was appointed by Dniprovskyy District Court of Kyiv. However, she says, the prosecution is delaying the appropriate investigative action. Only examination can determine whether or the circumstances that Judge Mykola Chaus of Dniprovskyy District Court took into account when deciding on Hennadiy Korban’s arrest. Now this is only an attempt to delay the case,” the human rights activist believes.

In his speech lawyer Oleksandr Lysak stressed that prosecutors were seeking adjournment of the hearing under pretext of summoning witnesses to still obtain the opinion of forensic examination on the Hennadiy Korban’s health conditionHe is confident that without this conclusion the legality of the proceedings in Dniprovsky District Court and the Appeal Court of Kyiv is a big question.

In addition, lawyer Oleksiy Shevchuk said that the relevant prosecutors’ petition was not submitted in a duly manneras it does not specify a judge or the number of criminal proceedings under which it was submitted. “It is not specified on whose part this petition is filed and who filed it, who confirms the powers and in what way the powers of a person who filed the petition are confirmed. It was not substantiated whether the person had the right to file a petition,” said Oleksiy Shevchuk.

Having heard the arguments of the parties, the panel of judges consisting of Denis Masenko, ValeriHlynnyy and Victor Lashevych decided to satisfy the prosecutors’ motion to summon as witnesses deputy Deputy Chief Physicians of Amosov Institute Oleksandr Berehovyy and Kostyantyn Rudenko and Doctor Irina Shvets.

In turn, the defense filed the petition to call as witnesses doctors of the Center for Emergency Medicine of Kyiv Biloshapk and Sidorchuk who provided medical aid to the politician in Dniprovskyy District Court, and doctors of the Medical center Family Medicine Clinic"Lyesnichuk and Kikhtenko who examined Hennadiy Korban in Dnipropetrovsk and followed up the politician’s health condition during his house arrest.
