Tomorrow, on February 2, at 11.00, Appeal Court of Kyiv will continue hearing of the complaints submitted by Hennady Korban’s lawyers against the decision of the judge of Dniprovsk District Court of Kyiv Mykola Chaus on changing pretrial restriction for the politician from house arrest to detention.
During the previous court session consideration of the appeal was adjourned once again. This time, the panel of judges consisting of Denys Masenko, Victor Hlynianyy and Valeriy Lashevych explained their decision with the need to examine materials added to the appeal by the lawyer Oleksandr Miroshnyk, as well as by the need to equip the courtroom in accordance with the requirements of the European Convention for the Protection of Human Rights and Fundamental Freedoms. It means that the metal cage, where currently Hennady Korban is kept during the trial, must be replaced by a transparent plastic cube, which will not assault dignity of a person detained therein.
According to the defence, pretending to protect the rights of their client, the court banally delays the case. The politician has been unlawfully under arrest for over a month, while the court has not even begun to consider the appeal on the merits, despite the fact that according to the law the appeal is to be considered as soon as possible. Consequently, there is a violation of a basic human right – the right to freedom, emphasize Hennady Korban’s lawyers.
