The audacity that the demonstration trial of Hennady Korban is accompanied by is related to the fact that all the actors are kept on the hook by the authorities. The lawyer of one of the leaders of UKROP Oksana Tomchuk expressed such an opinion during the press conference that was held in UNIAN news agency on January 27.
“Today, all the participants in the trial are anyhow on the hook. The investigating judge Chaus, whose dismissal is to be considered tomorrow by the High Council of Justice, is kept on the hook. And to tell the truth, we already know the result – he will not be dismissed. He has gained his indulgence,” said the lawyer.
She also admits the possible biased position of the panel of judges at the Appeal Court of Kyiv, who are considering “Korban’s case”. The presiding judge in the trial is the judge Masenko, and Oksana Tomchuk assumes that he has been transferred to Kyiv from Lugansk under certain conditions. “This person was transferred, if I am not mistaken, from Lugansk. Probably under certain conditions. This is only my guess,” said the lawyer.
According to human rights defender, the judge Hlynianyy cannot be impartial while considering “Korban’s case” due to his family ties. “As for the judge Hlynianyy there is information that his son works in the Prosecutor’s Office of Kyiv, so we can clearly observe their family ties.”
Hennady Korban’s lawyer considers that such cases will bring no good to the judges. “It cannot be possible that such things last for a long time. Sooner or later, someone will say, look, this is the same judge Chaus, hue and cry. And instead of one or two criminal cases he will get twenty-two criminal cases, and will have to hide somewhere as Rodion Kireev. The judges ignore the lessons of history teaching them,” stated Oksana Tomchuk.
It is to be recalled, on January 28 the session of the High Council of Justice on considering dismissal of several judges is to be held. In particular, the disciplinary proceedings according to the conclusions of the Interim Commission on the judge of Dniprovsk District Court of Kyiv Mykola Chaus are to be considered.
Judge Mykola Chaus is known for making knowingly unjust decisions on the activists of Automaidan during the Revolution of Dignity, he has also organized unlawful 30-hour demonstration trial of one of the leaders of UKROP Hennady Korban and made illegal decisions on the other defendants in “Korban’s case”.
