On January 22, at 11:27, Kyiv Appeal Court started to consider once again the appeal submitted by the defence of the chairman of UKROP political council Hennady Korban against the decision of Dniprovsk District Court of Kyiv on changing pretrial restriction from house arrest to detention until February 25. The case is considered by the panel of judges consisting of Denys Masenko, Valeriy Lashevych and Victor Hlynianyy.
The representatives of the embassies of the United States, European Union, Poland, Germany and Ukrainian MPs are also present at the court session. There are many journalists and politician’s supporters in the courtroom, at the beginning of the hearing they have performed Ukraine’s national anthem, and they are holding banners with the words in support of Hennady Korban. They have also hung on the wall of the courtroom the banner with the words “Korban in prison – the best gift for Putin”.
It is to be noted that despite the norms of European law Hennady Korban is still kept in a cage.
It is to be recalled, on January 13, 2016 Court of Appeal of Kyiv partially granted the motion submitted by Hennady Korban’s defence. The judge Denys Masenko decided to send a request to Kyiv City Bureau of Forensic Examination in order to get an expert conclusion on the politician’s health condition. In addition, the court decided to send a request to the State Judicial Administration concerning the equipment of the courtroom according to the norms of the European Convention on Human Rights. This decision was made after Hennady Korban’s lawyers had filed a request to release the politician from the cage where he was held during the court session, as keeping person whose guilt is not proven by the court in the cage contradicts European law.
