On January 22, at 11.00, Appeal Court of Kyiv will continue hearing of the appeal submitted by Hennady Korban’s lawyers against the decision of Dniprovsk District Court of Kyiv on changing pretrial restriction for the politician from house arrest to detention. It is to be recalled, during the last court session the lawyers of the chairman of UKROP political council filed a request on his release from the metal “cage” where he is kept during the hearing. The lawyers insist that this is a violation of human rights as the politician’s guilt is not proven by the court. In addition, the defence has filed a motion to adjourn hearing until they get the results of their client’s forensic examination that was assigned and started at the request of the prosecution. These requests were partly satisfied, as the court decided to send a letter to the State Judicial Administration concerning the appropriate equipment of the courtroom according to the requirements of the European Convention on Human Rights, and to make a request about the results of medical forensic examination. The lawyers called positive such results of the hearing. “Defence has raised its game over the prosecutors and gone on the offensive,” said Hennady Korban’s lawyer Oleksiy Shevchuk. However, according to the lawyer Oksana Tomchuk, the defence has not changed its opinion about the biased position of the panel of judges consisting of Denys Masenko, Victor Hlynianyy and Valeriy Lashevych, and still considers that they should be disqualified.
